Access conditions

Access to this incentive scheme depends on the cumulative verification of the following access conditions at the date of submission of the application:
a) The candidate must have permanent residence in the improvement or improvement built on the ground to which the application refers for at least three years;
b) The applicant or the members of the household are not owners or tenants of another building or autonomous fraction intended for housing;
c) The applicant or the members of the household are not relatives or relatives of the landlord in the direct line or in the collateral line;
d) The household earns a maximum gross monthly income per capita (RMBpc) of 1100€;
e) The improvement or improvement meets conditions of habitability, safety and healthiness.

Recipients

Properties whose enjoyment of the land has been ceded by the owner, through a contract, regardless of whether it corresponds in whole or in part to a matrix article, in return for a monetary remuneration, authorizing the enjoyer to build improvements or improvements, intended for permanent housing;
Owner of the land - whoever has the acquisition of the land registered in his favor, or proves his ownership by any legally admissible means;
Owner of the improvement or improvement - whoever has the improvement registered in his favor, or proves his ownership by any legally admissible means.

Other information

Financial Support: For the purpose of granting support, the value of the plot (VL) to be acquired will be calculated based on the following rules and values: a) Apply €60/m² to 50% of the plot area, with a maximum of 300 m²; b) Apply €5/m² to the remaining area of the plot not covered by the previous point, with a maximum of 700 m². The amount of support to be granted is the result of applying the percentage specified in the table annexed to this regulation (which forms an integral part of it) to the VL, taking into account the income class of the applicant household. When the purchase price of the plot (VAL) is lower than the VL, the amount of support to be granted is the result of applying the percentage shown in the following table to the VAL, again taking into account the income class of the applicant household: RMBPC Limits % Applied to VL or VAL 0 < RMBPC ≤ 350 95% 350 < RMBPC ≤ 425 90% 425 < RMBPC ≤ 500 85% 500 < RMBPC ≤ 575 80% 575 < RMBPC ≤ 650 75% 650 < RMBPC ≤ 725 70% 725 < RMBPC ≤ 800 65% 800 < RMBPC ≤ 875 60% 875 < RMBPC ≤ 950 55% 950 < RMBPC ≤ 1025 50% 1025 < RMBPC ≤ 1100 45% RMBPC = Gross Monthly Household Income Per Capita Financial support is granted at the time of signing the deed of sale, by a check issued in the seller’s name.

Obligations of the beneficiary

Beneficiaries of the support are obliged to:

a) To execute the deed of purchase and sale within a maximum period of ninety days from the date of communication of authorization of the support, except for an impediment that is not attributable to it;
b) Not to use the property built in the acquired building for any purpose other than permanent housing;
c) Promote the registration of the burden of inalienability.

Burden of inalienability:

The acquired properties are subject to a burden of inalienability, subject to registration, whose registration must mention its nature and term, which is in force for a period of ten years, from the date of the deed of purchase and sale.

If the owner wishes to sell the property before the end of the period of inalienability, he may request the department of the Regional Government responsible for housing to lift the burden, by paying the Autonomous Region of the Azores the following amounts:

a) Double the financial contribution granted, in the event that the sale takes place within the first five years of the term of the inalienability encumbrance;
b) The amount of the financial contribution granted, plus 50%, if the sale takes place after the five-year period of the inalienability burden and before the expiry of the 10-year period.

Expiry of the encumbrance:

The burden of inalienability lapses in cases where there is a sale or award of the dwelling in enforcement proceedings for debts arising from loans for which the building is collateral, but it does not exonerate the debtor from the payment to the Autonomous Region of the Azores of the amounts due, depending on the time when the award or sale takes place.

The expiry of the burden of inalienability due to the expiry of the period determines the official registration of this fact.

The verification of the provisions of the preceding paragraphs is assessed by the notary at the time of the execution of the deed of purchase and sale or the award of the dwelling.

Transferability of the right to support

The right to financial support is transferred upon the death of the holder, at the request of the respective legal heirs, provided that the conditions for access are met and upon presentation of proof of hereditary succession.
