This service allows you to request support to solve situations of serious housing shortage.

Its purpose is to solve situations of serious housing shortage through the rental, under a supported rent regime, of housing acquired or built by the Autonomous Region of the Azores or by subletting housing rented by the Autonomous Region of the Azores in the real estate market.

Recipients

This support program is intended exclusively for citizens with permanent residence in the Autonomous Region of the Azores for at least three years (on the residence certificate or other document that proves it, it must expressly state X YEARS) and who are not debtors to the tax authorities and social security or, if so, their debts are covered by any regularization plan accepted by the creditors.

Situations covered

  • Permanent residence of households in buildings, parts of buildings or temporary structures characterized by serious deficiencies in solidity, safety, healthiness or overcrowding;
  • Urgent, permanent or temporary relocation of households without a place to live, namely by total or partial destruction of their homes and demolition of the buildings or temporary structures in which they lived;
  • Others not previously provided for that translate into situations of housing precariousness, thus recognized by order of the member of the Government with competence in housing matters, duly justified.

Requirements for the provision of the servisse

Access to support is subject to the cumulative verification of the following conditions:

  • Be considered a household in a situation of serious housing shortage;
  • Be considered a needy household. Concept.

Anyone whose corrected gross annual income (RABC) is less than three national minimum annual earnings (RMNA) practiced in the Autonomous Region of the Azores, observing the concepts of gross annual income (RAB), RABC and RMNA, the definitions and criteria established in Article 3(a) and Articles 4 and 5 of Decree-Law No. 158/2006, of 8 August.

  • "RMNA" means the value of the guaranteed minimum monthly wage (RMMG) practiced in the Autonomous Region of the Azores, referred to in paragraph 1 of article 266 of the Labour Code, multiplied by 14 months.

«RAB» the amount resulting from the sum of the gross annual income, under the terms of the Personal Income Tax Code (CIRS), earned by all members of the applicant's household.

"RABC" is the amount resulting from the sum of the gross annual income earned by all members of the applicant's household, corrected for the following factors:

  • Total gross annual income earned by persons who have lived in a household with the applicant for more than one year;
  • Number of dependents in the applicant's household and persons who have lived in the same household with the applicant for more than one year;
  • Number of people in the household with disabilities with a degree of proof of disability equal to or greater than 60%.

Thus, the RAB of the applicant's household is corrected:

  1. By adding up the gross annual income earned by people who have lived in a household with the applicant for more than one year;
  2. By deducting the amount corresponding to 0.5 of the RMNA for each dependent;
  3. By deducting the amount corresponding to 0.5 RMNA for each person with a disability, cumulative with the correction provided for in (2).
  • None of the members of the household owns, in any capacity, elements, another dwelling that can meet the housing needs of the household;
  • None of the members of the household is benefiting from public support for housing purposes only, unless the support is justified by the constitution of a new household or for the provisional and urgent resolution of the housing situation of the household.

Average time to perform

The application must be completed within 60 working days from the date of submission of the form, up to the annual amount of the amount entered in the Budget of the Autonomous Region of the Azores, which will take into account the resulting commitments and those previously assumed. Deadlines are suspended in accordance with the law.

In the application phase, the services will take the necessary steps to assess the eligibility of the application. For this purpose, a period of no less than 10 working days will be set for candidates to submit the elements requested.

Failure to present the aforementioned elements, for reasons attributable to the candidate, determines the exclusion of the candidacy.

Other information

Priorities in the instruction of cases

  • Priority is given to the application processes that configure situations of greater gravity, namely:
  • Households without a place to live;
  • Households that have to be evicted because the property where they live does not offer minimum safety or health conditions;
  • Households that include people with disabilities or bedridden;
  • Households that include children aged 10 years and under;
  • Households that include the elderly;
  • Cases in which, for reasons of domestic violence, rehousing is considered urgent.

From the above, combined with the annual amount of the amounts set out in the Plan and entered in the Budget of the Autonomous Region of the Azores, it follows that:

  • The analysis and decision of the applications is made according to the seriousness of the housing situation of the applicant and his/her household and not in chronological order of submission of the application;
  • The decision to admit the application is suspended until the conditions for it to be issued are met, without prejudice to the provisions of the following paragraphs and articles 110 and 112 of the Code of Administrative Procedure;
  • Candidates must be notified of the suspension of the application;
  • If, due to suspension, the relevant calendar year is exceeded with regard to the documents submitted in the application, the decision on the admissibility of the application must be preceded by the updating of the documents that appear necessary for this purpose;
  • Exclusion and termination rules of the contract;
  • Admitted candidates who do not accept, expressly or tacitly, without valid justification, the housing intended for them or who, without just impediment, do not attend the act of granting the lease or sublease contract are excluded;
  • Excluded candidates are prevented from accessing, in this or any other capacity, this type of support for a period of two years;
  • Lease and sublease contracts will be terminated under the terms provided for in the NRAU. In the event that the termination of the contract is based on non-payment of rent, there will also be payment of the outstanding amounts, plus default interest at the legal rate in force, without prejudice and other sanctions legally applicable to the case;
  • Beneficiaries whose contract is terminated may be prevented from accessing, in this or another capacity, this type of support for a period of two years, by decision of the member of the Regional Government with competence in housing matters, given the seriousness of the facts committed.
